These Terms of Use ("Terms") govern your access to and use of the websites, online forms, content, communications, and related online services operated by Carbon Public Adjusting LLC ("Carbon Public Adjusting," "we," "us," or "our") that link to these Terms (the "Site").
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. Who We Are
Carbon Public Adjusting LLC is a California-licensed public insurance adjuster.

Business address: 2173 Salk Avenue, Suite 250, Carlsbad, CA 92008.
We represent insured policyholders in connection with first-party insurance claims. We do not represent insurance companies.
2. Website Is Informational Only
The Site is provided for general informational and marketing purposes only. It may describe services we offer, but it is not legal advice, insurance advice, financial advice, emergency advice, claim-specific advice, or a substitute for professional review of your specific facts.
You should not rely on Site content as a basis for making claim decisions, delaying mitigation, missing insurance-policy deadlines, failing to notify your insurer, failing to document damage, or failing to seek legal, insurance, contractor, engineering, safety, or emergency assistance.
3. No Public-Adjuster Engagement Is Created Online
Submitting a form, uploading documents or photographs, requesting a consultation, calling us, texting us, emailing us, or otherwise communicating with us through or because of the Site does not create a public-adjuster engagement, agency relationship, fiduciary relationship, or contract for adjusting services.
We provide public adjusting services only after both parties execute a separate written public-adjuster contract that complies with applicable law, including required disclosures, fee terms, cancellation rights, and any required statutory notices.
Until that separate contract is signed, we are not your public adjuster, do not represent you in your insurance claim, and do not owe you public-adjuster duties.
4. No Emergency, Safety, Mitigation, or Deadline Management
The Site is not intended for emergencies, active-loss management, safety instructions, mitigation directions, insurer notice, proof-of-loss submission, claim-deadline management, or legal preservation.
If you are experiencing an emergency, unsafe condition, active leak, fire, flood, structural danger, medical issue, or other urgent situation, contact emergency services, qualified professionals, your insurer, or other appropriate resources.
You are responsible for reviewing your insurance policy, complying with insurer notice requirements, mitigating damage where required, documenting loss, and meeting all deadlines unless and until you have entered into a separate written agreement with appropriate professionals who have agreed to assist with those obligations.
5. Public-Adjuster Contract Controls
Any public adjusting services are governed by a separate written public-adjuster contract, not these Terms. If there is a conflict between these Terms and a signed public-adjuster contract, the signed contract controls with respect to the public adjusting services.
Nothing in these Terms limits any non-waivable rights you may have under applicable insurance law, consumer-protection law, or other law.
6. No Guarantee of Claim Outcome
We do not guarantee any claim result, settlement amount, payment amount, coverage determination, claim timeline, insurer response, appraisal outcome, litigation outcome, or other result. Any examples, educational materials, case studies, testimonials, or past results are illustrative only and do not guarantee or predict your outcome.
7. No Legal Advice
We are not a law firm and do not provide legal advice. Public adjusters are not attorneys. For legal advice regarding coverage disputes, bad faith, litigation, policy interpretation, deadlines, rights, obligations, or legal strategy, consult a licensed attorney.
8. Eligibility
You must be at least 18 years old and able to enter into a binding agreement to use the Site. By using the Site, you represent that the information you provide is accurate and that you have the right to submit it.
9. Your Submissions
If you submit information, documents, photographs, videos, estimates, reports, insurance materials, or other content through the Site or to us:
You represent that you have the right to submit the materials;
You represent that the materials are accurate to the best of your knowledge;
You authorize us to use the materials to respond to your inquiry, evaluate whether we may be able to assist, communicate with you, comply with law, and protect our rights;
If you later engage us, submitted materials may be used in connection with the services, subject to the written public-adjuster contract and applicable law.
Do not submit highly sensitive information through the Site unless requested. We may provide more secure channels for claim-related materials after engagement.
10. Acceptable Use
You agree not to:
Use the Site for unlawful, fraudulent, misleading, or abusive purposes;
Submit false, misleading, defamatory, infringing, or fraudulent information;
Submit information in connection with insurance fraud or any unlawful claim activity;
Upload malware, harmful code, or content that disrupts the Site;
Attempt to gain unauthorized access to our systems;
Scrape, crawl, copy, or harvest Site content except as permitted by law;
Interfere with Site security or operation;
Misrepresent your identity, authority, property ownership, insurance status, or claim status.
We may restrict, suspend, or terminate Site access for any violation of these Terms.
11. Communications Consent
If you provide your contact information and opt in where required, you consent to receive communications from us regarding your inquiry, consultation request, potential engagement, or services, including by email, phone calls, and text messages.
Message and data rates may apply. Message frequency may vary. You may opt out of marketing texts by replying STOP and marketing emails through the unsubscribe link provided.
Public-adjuster solicitation is regulated. We do not intend to solicit public-adjuster engagements in violation of applicable law, including restrictions on solicitation during loss-producing events, after declared disasters, or during prohibited hours.
12. Fees, Compensation, and Third-Party Compensation
Site access is currently provided without charge.
Public-adjuster fees, if any, are governed only by a separate written public-adjuster contract. No public-adjuster fee is owed merely because you used the Site, submitted a form, requested a consultation, or communicated with us.
We do not receive claim-related compensation except as permitted by applicable law and disclosed as required. Any compensation, referral relationship, contractor relationship, vendor relationship, or other financial interest connected to a claim will be handled in accordance with applicable law and the written public-adjuster contract.
13. Intellectual Property
The Site and its content — including text, graphics, logos, designs, names, marks, layouts, and other materials — are owned by or licensed to us and protected by intellectual-property laws. You may use the Site for personal, non-commercial, informational purposes only. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or exploit Site content without our prior written permission.
14. Third-Party Links and Services
The Site may link to third-party websites, tools, services, or resources. We do not control and are not responsible for third-party content, services, policies, security, accuracy, or practices. Links do not imply endorsement.
15. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Site, you acknowledge our Privacy Policy.
16. Disclaimers
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND ERROR-FREE OPERATION.
WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, COMPLETE, CURRENT, OR FREE FROM ERRORS, VIRUSES, OR HARMFUL COMPONENTS.
Nothing in these Terms limits any non-waivable rights under applicable law.
17. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CARBON PUBLIC ADJUSTING LLC AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO SITE USE WILL NOT EXCEED $100.
This limitation applies only to Site use. It does not limit any rights or obligations arising under a separately executed public-adjuster contract or any non-waivable duties under applicable law.
18. Indemnification
You agree to indemnify and hold harmless Carbon Public Adjusting LLC and its owners, officers, directors, employees, contractors, agents, affiliates, and service providers from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to: your misuse of the Site; your violation of these Terms; your submission of false, misleading, infringing, or unlawful content; or your violation of law or third-party rights.
19. Copyright Concerns
If you believe material on the Site infringes your copyright, contact us at info@carbonpublicadjusting.co with a description of the material and your contact information, and we will review it.
20. Suspension and Termination
We may suspend, restrict, or terminate access to the Site at any time, with or without notice, including if we believe you violated these Terms or used the Site improperly.
21. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
Any dispute arising from or related to Site use will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction there, unless applicable law requires otherwise.
Nothing in this section limits your right to file a complaint with the California Department of Insurance or another regulator.
22. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted with a revised "Last Updated" date. Your continued use of the Site after updated Terms are posted means you accept them.
23. General Terms
These Terms and the Privacy Policy are the entire agreement between you and us regarding Site use. They do not govern any separate written public-adjuster contract.
If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent. We may assign these Terms in connection with a business transfer.
