This Privacy Policy explains how Carbon Public Adjusting LLC ("Carbon Public Adjusting," "we," "us," or "our"), a California-licensed public insurance adjuster, collects, uses, discloses, and protects personal information through our websites, online forms, communications, and related online services that link to this Privacy Policy (collectively, the "Site").
California Department of Insurance Public Insurance Adjuster License No. 6017519. Business address: 2173 Salk Avenue, Suite 250, Carlsbad, CA 92008.
This Privacy Policy covers information collected through the Site and related online interactions. It does not replace or modify any separate written public-adjuster contract, claim-handling authorization, insurance privacy notice, or other agreement that may apply if you engage us for public adjusting services.
1. Important Notice About Public Adjusting Services
Submitting information through the Site, requesting a consultation, uploading documents or photos, calling us, texting us, or communicating with us does not create a public-adjuster engagement, agency relationship, or claim representation.
We provide public adjusting services only after execution of a separate written public-adjuster contract that complies with applicable law. Information submitted before engagement may be used to respond to your inquiry, evaluate whether we may be able to assist, comply with law, and protect our rights.
2. Notice at Collection
At or before the point we collect personal information, we want you to know: the categories we collect (Section 3), the purposes we use them for (Section 4), that we do not sell your personal information but we do share certain identifiers and online-activity information for cross-context behavioral advertising (Section 7), and how long we keep each category (Section 9). You can exercise your privacy rights under Section 8, including opting out of sharing.
3. Personal Information We Collect
We may collect the following categories of personal information:
Category | Examples |
|---|---|
Identifiers | Name, email address, phone number, mailing address, IP address, online identifiers |
Customer records information | Address, phone number, insurance policy information, claim information, signature, communications with us |
Property and claim information | Property address, loss date, type of loss, insurer, claim number, photos, videos, estimates, reports, correspondence, related documents |
Commercial information | Services requested, consultation history, engagement status, billing or payment-related information |
Internet and device information | Browser type, device information, pages viewed, referring URLs, interactions with forms, cookies, analytics and advertising identifiers |
Approximate location information | Approximate location inferred from IP address; property location you provide |
Audio, visual, and electronic information | Photos, videos, voicemails, uploaded documents (we do not currently record calls) |
Sensitive personal information | See Section 3.1 |
We do not intentionally collect sensitive personal information unless it is reasonably necessary to respond to your inquiry, evaluate a potential engagement, perform services after engagement, comply with law, or protect our rights.
Please do not submit highly sensitive information through the Site unless requested. If you engage us, we may provide more secure channels for claim-related materials.
3.1 Sensitive Personal Information
Depending on what you submit, we may collect sensitive personal information ("SPI"), which can include financial-account information and information contained in claim, property, financial, or insurance materials you provide.
We use and disclose SPI only for the purposes permitted under California Civil Code § 1798.121 — namely to perform the services you request, to prevent fraud, to ensure security, and to comply with law. We do not use SPI to infer characteristics about you, and we do not sell or share SPI for cross-context behavioral advertising. You may request that we limit our use of SPI (Section 8).
4. How We Use Personal Information
We use personal information to:
Respond to inquiries and consultation requests;
Evaluate whether we may be able to assist with a claim;
Communicate with you about your inquiry, potential engagement, or services;
Provide public adjusting services after you enter into a separate written contract with us;
Review, prepare, present, or discuss insurance claim information where authorized;
Operate, maintain, secure, and improve the Site and our business systems;
Conduct analytics and advertising (see Section 7);
Detect, prevent, and respond to fraud, misuse, security incidents, or illegal activity;
Comply with insurance, licensing, regulatory, tax, accounting, legal, and recordkeeping obligations;
Establish, exercise, or defend legal rights.
We do not use personal information for materially different, unrelated, or incompatible purposes without providing notice where required by law.
5. How We Disclose Personal Information
We may disclose personal information to:
Service providers and contractors that help with website hosting, form processing, communications, analytics, advertising, security, storage, CRM, document management, and business operations;
Professional advisors, including attorneys, accountants, auditors, compliance consultants, and insurers;
Insurance-claim participants, only where appropriate and authorized, including insurers, insurer representatives, contractors, estimators, engineers, consultants, experts, or others involved in a claim;
Regulators, government authorities, courts, law enforcement, or other parties where required or permitted by law;
Business-transaction parties in connection with a merger, acquisition, financing, reorganization, or sale of assets;
Other parties with your consent or at your direction.
Categories disclosed in the past 12 months. We have disclosed identifiers, customer records information, property and claim information, commercial information, and internet/device information to service providers and professional advisors for business purposes. We have shared identifiers and internet/device information for cross-context behavioral advertising (Section 7). We have not sold personal information for money.
6. Insurance-Specific Privacy
Because we are a public adjusting business, information collected in connection with insurance transactions may be subject to insurance-specific privacy obligations, including the California Insurance Information and Privacy Protection Act, California Insurance Code § 791 et seq., and potentially the Gramm-Leach-Bliley Act and related privacy rules.
Claim-related information may include nonpublic personal information, privileged information, financial information, property information, policy information, communications with insurers, and other sensitive materials. We use and disclose such information only as permitted by law, authorized by you, necessary to evaluate or perform services, or required to comply with legal or regulatory obligations. We may provide additional privacy notices or procedures in connection with an actual public-adjuster engagement.
7. Cookies, Analytics, and Advertising
We use cookies, pixels, analytics tools, and similar technologies — including Google Analytics and the Meta pixel — to operate the Site, understand traffic, improve performance, remember preferences, detect security issues, and measure and deliver advertising.
These technologies may collect information such as IP address, device identifiers, browser type, referring pages, pages viewed, time spent, and interactions with forms.
Sale and sharing. We do not sell personal information for money. However, our use of advertising and analytics technologies (such as the Meta pixel and Google Analytics advertising features) may constitute "sharing" of personal information for cross-context behavioral advertising under California law.
Your choices. You may opt out of this sharing at any time by:
Using our "Your Privacy Choices" / "Do Not Sell or Share My Personal Information" link in the Site footer; and/or
Enabling a recognized opt-out preference signal such as the Global Privacy Control (GPC) in your browser, which we treat as a valid request to opt out of sharing.
You can also control cookies through your browser settings, though some features may not function properly if cookies are disabled.
8. California Privacy Rights
Subject to verification and legal limitations, California residents may have the right to:
Know what categories of personal information we collect, use, disclose, or share;
Access specific pieces of personal information;
Delete personal information;
Correct inaccurate personal information;
Opt out of the sharing of personal information for cross-context behavioral advertising (we do not sell personal information);
Limit certain uses and disclosures of sensitive personal information;
Not be discriminated against for exercising privacy rights.

10. Data Security
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information. No system, website, transmission, or storage method is completely secure. You should avoid submitting highly sensitive information through unsecured channels.
11. Texts, Calls, and Email Communications
If you provide your contact information and opt in where required, we may contact you by email, phone, or text message regarding your inquiry, consultation request, potential engagement, or services. Message and data rates may apply; message frequency may vary. You may opt out of marketing texts by replying STOP and opt out of marketing emails using the unsubscribe link in those emails.
